On Monday 21 March 2016 the Supreme Court will hear the appeals of BNY Mellon Corp Trustee Services Ltd v LGB Capital & Anor concerning whether the Court of Appeal erred in law in its construction of the terms of enhanced capital notes by relying on technical and specialist information as part of the factual matrix.. This will be heard in Court 2 from 11am.

On Tuesday 22 March it will hear the appeal of PST Energy 7 Shipping LLC & Anor v O.W. Bunker Malta Ltd & Anor concerning contract for supply of fueloil and gasoil to vessels Res Cogitans at Tuapise, Russia. The court must decide if the contract is a contract of sales. If not, was it an implied condition of the contract that O.W. Bunker Malta Limited would perform its obligations to its supplier, in particular by paying for the goods timeously? It will be heard in Court 2 from 10.30am and will continue on Wednesday.
