On Tuesday 21 March and Wednesday 22 March, the Supreme Court will hear the appeal of Taurus Petroleum Ltd v State Oil Marketing Company of the Ministry of Oil, Republic of Iraq (SOMO). This will consider the identity of the beneficiary under letters of credit and the situs of debts under letters of credit. It will also consider whether there is a free standing principle of honest dealing beyond the rule that a judgment creditor cannot execute against a property that does not belong to the judgment debtor, the correct basis on which a court should exercise its discretion to make receivership orders, and the circumstances in which the State Immunity Act 1978, ss 13(2)(b), 14(2), and 14(4) allow immunity from execution. This will be heard in Courtroom 1.

On Wednesday 22 March, the Supreme Court will hand down the judgment in the case of AIG Europe Ltd v Woodman & Ors. The hand down panel will be Lady Hale, Lord Mance, Lord Reed and Lord Sumption. This appeal considered what the true construction of the words ‘in a series of related matters of transactions’ is, within the aggregation clause of a professional indemnity insurance policy.

On Wednesday 22 March, the Supreme Court will hand down the judgment in the case of Financial Conduct Authority v Macris. The hand down panel will be Lady Hale, Lord Mance, Lord Reed and Lord Sumption. This appeal considered what the meaning is of the words ‘any of the reasons contained in [a notice] relates to a matter which identifies a person’ contained in the Financial Services Markets Act 2000, ss 393(1) and (4).

On Wednesday 22 March, the Supreme Court will hand down the judgment in the case of Gordon v Scottish Criminal Cases Review Commission. The hand down panel will be Lady Hale, Lord Mance, Lord Reed and Lord Sumption. This appeal considered whether the Respondent erred in law in refusing to refer the appellant’s case to the High Court.

On Wednesday 22 March, the Supreme Court will hand down the judgment in the case of BPE Solicitors & Anor v Hughes-Holland (in substitution for Gabriel). The hand down panel will be Lady Hale, Lord Mance, Lord Reed and Lord Sumption. This appeal considered whether the losses suffered by the Appellant were losses which the Respondent owed a duty to protect him against, and whether the losses suffered by the Appellant are otherwise recoverable from the Respondent.

On Wednesday 22 March, the Supreme Court will hand down the judgment in the case of N v ACCG & Ors. The hand down panel will be Lady Hale, Lord Mance, Lord Reed and Lord Sumption. This appeal considered whether a commissioning body can, by its decision not to fund a particular option for contact, remove the jurisdiction of the Court of Protection to make a best interests decision about contact, and whether the failure to conduct a best interests assessment and/or determine the facts breached Mr N’s rights under the ECHR to a fair trial and a family life.

On Thursday 23 March, the Supreme Court will hear the appeal of SM (Algeria) v Entry Clearance Officer UK Visa Section. This will consider whether the appellant (the applicant) is a ‘direct descendant’ or ‘extended family member’ within the meaning of the Immigration (European Economic Area) Regulations 2006, Regulations 7 and 8. This will be heard in Courtroom 2.
