On Monday 2 February 2015 the Court will hear the appeal of Olympic Airlines S.A. v The Trustees of the Olympic Airlines S.A. Pension and Life Assurance Scheme regarding a petition to the Court to wind up the respondent company in a second insolvency by the appellant trustees of the staff pension scheme under the EC Insolvency Regulation. The Supreme Court must consider the meaning of the concept of “establishment” in the EC Insolvency Regulation and whether that concept determines secondary insolvency proceedings may be opened in a member state other than the state in which the centre of the debtor’s main interests is situated. It will be heard in Court 2 from 2pm and will continue on Tuesday from 10.30am.
On Monday 2 February the Privy Council will hand down judgment in The Presidential Insurance Company Ltd v Mohammed & Ors (Trinidad and Tobago) and Seetohul v Omni Projects Ltd (Mauritius). It will also hear the appeal of Maharaj & Anor v Johnson & Ors (Trinidad and Tobago) regarding when the cause of action in a tort of negligence first accrue in cases in which defective conveyancing causes financial loss. This will be heard in Court 3 following the judgment hand downs from 10.30am.
On Wednesday the Privy Council will also hear the appeal of Hunte & Anor v The State (Trinidad and Tobago) regarding whether the appellants suffered a serious miscarriage of justice by the virtue of deficiencies in the conduct of their trial. This will be heard in Court 1 from 10.30am and will continue on Thursday.
