On Tuesday 19 March, the Supreme Court will hear the appeal of Akcil & Ors v Koza & Ors. This appeal will consider whether the Recast Regulation, No. 1215/2012, art 24(2) confers exclusive jurisdiction on the English courts to determine the authority in England of directors appointed in foreign proceedings to the board of a foreign corporate shareholder of a company registered in England to cause or permit the foreign corporate shareholder to do anything as a shareholder of the English company. It will also consider whether art 24(2) confers exclusive jurisdiction against anyone other than the foreign corporate shareholder, such as its directors of a corporate shareholder as co-defendants. This will be heard in Courtroom 2.

On Tuesday 19 March, the Judicial Committee of the Privy Council will hear the appeal of Nurse v Republic of Trinidad & Tobago; Canserve Ltd v Republic of Trinidad & Tobago. This appeal will consider what the mental elements are, if any, of the offences created by the Customs Act, ss 212(a), 213(a) and 214, and whether the offences are of strict liability. It will also consider whether the Court of Appeal erred in applying a principle of attribution which resulted in Mr Nurse being treated as a principal rather than a secondary party whose liability depended on knowledge. This will be heard in Courtroom 3.

On Wednesday 20 March, the Supreme Court will hand down judgment in Takhar v Gracefield Developments Ltd & Ors. The proposed panel for hand down is Lord Kerr, Lady Arden and Lord Kitchin. This appeal considered whether a party who seeks to set aside a judgment on the basis that it was obtained by fraud must demonstrate that he or she could not have discovered the fraud by the exercise of reasonable (or due) diligence at the time of the original trial.

On Wednesday 20 March, the Supreme Court will hand down judgment in SAE Education Ltd v The Commissioners of HMRC. The proposed panel for hand down is Lord Kerr, Lady Arden and Lord Kitchin. This appeal considered whether the appellant was a college of Middlesex University and therefore an ‘eligible body’ within the meaning of the Value Added Tax Act 1994, Sch 9, Group 6, Item 1, exempting its supplies of education from VAT.

On Wednesday 20 March, the Judicial Committee of the Privy Council will hear the appeal of Maharaj v Petroleum Company of Trinidad & Tobago Ltd (Trinidad & Tobago). This will be heard in Courtroom 3.

On Thursday 21 March, the Judicial Committee of the Privy Council will hear the appeal of Singh v Commissioner of Police (Trinidad & Tobago). This will be heard in Courtroom 3.
