Izzy4Running from Tuesday 19 until Thursday 21 March 2013 is the appeal of Bank Mellat v Her Majesty’s Treasury. The matter will be heard by a panel of nine (L Neuberger, L Hope, L Hale, L Kerr, L Clarke, L Dyson, L Sumption, L Reed, L Carnwath) and concerns one of Iran’s largest privately owned commercial banks. In 2009 the Treasury made the Financial Restrictions (Iran) Order 2009 under the Counter-Terrorism Act 2008, Sch 7, which prevented any person in the UK financial sector from entering into or continuing to participate in any transaction or business relationship with the appellant bank. Under the statutory right of appeal contained in s 63 of the 2008 Act the appellants contend that the order was in breach of the rules of natural justice, and/or ECHR art 6, and/or the procedural obligation in Protocol 1 to the ECHR. On Wednesday 20 March 2013 the Supreme Court will hand down judgment in Hayes v Willoughby.
