On Monday 16 until Tuesday 17 July, the Supreme Court will hear the appeal of Poole Borough Council v GN (through his Litigation Friend, ‘The Official Solicitor’) & Anor. This appeal will consider whether the case of D v East Berkshire Community NHS Trust [2004] QB 558 is correct and should continue to govern the position of local authorities in respect of their duties to children living in their areas. This will be heard in Courtroom 2.

On Tuesday 17 until Thursday 19 July, the Judicial Committee of the Privy Council will hear the appeal of Bannerman Town, Millars and John Millars Eleuthera Association v Eleuthera Properties Ltd. This appeal will consider whether the Court of Appeal was wrong to find that the respondent had established possession over the property so as to give it title ahead of the competing claims of the appellant. This will be heard in Courtroom 3.

On Tuesday 17 until Thursday 19 July, the Supreme Court will hear the appeal of R (DA & Ors) v Secretary of State for Work and Pensions. This appeal will consider whether the application of the revised benefit cap, introduced by the Welfare Reform and Work Act 2016, s 8, to lone parents with children under two years old (i) unlawfully discriminates against the parents and/or the children, contrary to the ECHR, art 14, read with art 8 and/or art 2 of the First Protocol and in breach of the UK’s international obligations under the UNCRC, art 3; and/or (ii) is irrational. This will be heard in Courtroom 2.

On Wednesday 18 July, the Supreme Court will hand down the judgment in Williams & Anor v London Borough of Hackney. The proposed panel for hand down is Lady Hale, Lord Wilson and Lord Hodge. This appeal considered the lawfulness of the accommodation of the appellants’ children by the respondent under the Children Act 1989, s 20.

On Wednesday 18 July, the Supreme Court will hand down the judgment in Mills v Mills. The proposed panel for hand down Lady Hale, Lord Wilson and Lord Hodge. This appeal considered the proper approach to applications to vary periodical payments orders made pursuant to the Matrimonial Causes Act 1973, s 31(7) after the grant of a decree of divorce and in particular whether, provision having already been made for the wife’s housing costs in the capital settlement in the original consent order of 2002, the Court of Appeal were wrong in taking these into account when increasing the wife’s periodical payments under the joint lives spousal maintenance provision contained in the 2002 order.
