On Monday 16 February 2015 the Court will hear the appeal of R (Bourgass & Anor) v Secretary of State for Justice regarding the decisions to place and/or keep the appellants prisoners in segregation. The Court must decide if the decisions were unlawful under the ECHR, art 6, and common law rules of procedural fairness. It will be heard in Court 2 from 11am and will continue on Tuesday at 10.30am.

On Wednesday 11 February 2015 will hand down judgment in Jackson v Murray & Anor (Scotland) regarding whether the appellant was contributory negligent at all to her accident when she was struck by the respondent’s car and, if she was, whether the Courts were nonetheless wrong in their assessment of the percentage of her contribution. It will be handed down in Court 1 from 9.45am.

On Wednesday the Court will also hear the appeal of Shahid v Scottish Ministers (Scotland) concerning the lawfulness of the appellant prisoner’s segregation. The Court must decide whether the segregation was unlawful because it failed to adhere to the time limits set out in to Prisons and Young Offenders Institution (Scotland) Rules 2006 and/or breached the appellant’s rights under the ECHR, arts 3 & 8. It will be heard in Court 2 from 10.30am.

On Monday 16 February the Privy Council will hand down judgment in National Stadium Project (Grenada) Corporation v NH International (Caribbean) Limited (Trinidad and Tobago) and Director of Public Prosecutions v Nelson (Antigua and Barbuda). It will also hear the appeal of Alcide v Desir & Anor (St Lucia) regarding the law of undue influence and its application in the appellant’s case of a sale of land at a substantial undervalue. It will be heard in Court 3 following the judgment hand downs at 11am.
