On Monday 16 December 2019, the Supreme Court will hand down judgment in Patel v Secretary of State for the Home Department and Secretary of State for the Home Department v Shah. These appeals consider the scope of the Zambrano principle which states that a non-member state national parent of a EU citizen child resident within the EU is entitled to reside in the EU.

On Monday 16 and Tuesday 16 December 2019, the Court will hear the appeal of XX v Whittington Hospital NHS Trust. This appeal considers whether the Respondent can recover damages for expenses of surrogacy arrangements which she intended to make in the UK or elsewhere. The Court will also consider whether it is correct to differentiate between “own egg” and “donor egg” surrogacies in awarding damages for such surrogacy expenses.
