On Tuesday 16 June 2015 the Court will hear the conjoined appeals of John Mander Pension Scheme Trustees Limited v Commissioners for Her Majesty’s Revenue and Customs regarding what tax year should the respondent have assessed the appellant’s tax. The appellant gave notice withdrawing approval for tax purposes from a pension scheme, of which he was the sole trustee. The parties’ dispute when the assessment for charges to tax occurred. It will be heard in Court 2 from 10.30am.

On Wednesday 17 June the Court will hand down judgment in the following: Aspect Contracts (Asbestos) Ltd v Higgins Construction Plc concerning an implied term in the parties’ contract that could allow the respondents to recover the payment they made to the appellants as a result of an adjudicator ruling, if they were successful in seeking a final determination by litigation; BPE Solicitors & Anor v Gabriel concerning whether a solicitor has a duty to give general commercial advice. These will be handed down in Court 1 from 9.45am.

On Wednesday the Court will also hear the appeal of Bank of Cyprus UK Ltd v Menelaou concerning whether the Bank was entitled to an equitable charge over residential property by subrogation to an unpaid vendor’s lien, where the Bank’s involvement in the acquisition of the property amounted only to an agreement to release charges over a previous property. This will be heard in Court 2 from 10.30am and will continue on Thursday.

On Monday 15 June the Privy Council will hand down judgment in Maharaj & Anor v Johnson & Ors (Trinidad and Tobago) and Peerless Limited v Gambling Regulatory Authority & Ors (Mauritius). These judgments will not be delivered in Court. On Tuesday 16 June the Council will hear the appeal of Robinson (Appellant) v The State (Respondent) (Trinidad and Tobago) regarding an appeal against a conviction for murder. On Wednesday 17 June the Council will hear the appeal of Krys & Ors v KBC Partners LP & Ors (British Virgin Islands) concerning what is the proper construction of “following the sale of all Investments of the Partnership” in Clause 7.2 of the Articles of Value Discovery Partners LP for the purpose of determining how to allocate the Partnership’s income and gains when the Partnership comes to an end. These will be heard in Court 3 from 10.30am on their respective days.
