On Monday 14 and Tuesday 15 May, the Supreme Court will hear the appeal of R (Steinfeld & Anor) v Secretary of State for the Home Department (in substitution for Secretary of State for Education. This appeal will consider whether the ban on different-sex couples entering into civil partnerships breaches the appellants’ rights under ECHR, art 14, together with art 8. This will be heard in Courtroom 1.

On Monday 14 May, the Judicial Committee of the Privy Council will hear the appeal of Jacpot Ltd v Gambling Regulatory Authority (Mauritius). This appeal will consider whether the appellant should be granted leave to appeal to the Judicial Committee of the Privy Council as of right, under the Constitution of Mauritius, s 81(1)(b), or by special leave of the Judicial Committee of the Privy Council under s 81(5). It will also consider whether, and in what circumstances, the respondent is entitled to revoke an applicant’s gaming licence under the Gambling Regulatory Authority Act 2007, ss 99(1)(m) and 99(1)(k), and whether the respondent is bound by the opinion of the Commissioner of Police when considering whether to revoke a licence under s 99(1)(k). This will be heard in Courtroom 3.

On Tuesday 15 and Wednesday 16 May, the Judicial Committee of the Privy Council will hear the appeal of Warren v The State (Pitcairn). This appeal will consider whether the Appellant had a fair trial by an independent tribunal under the Pitcairn Constitution, s 8 and whether parts of the Pitcairn Constitution should be struck down or declared invalid because of the lack of a representative legislature. It will also consider whether the absence of a Pitcairn specific judicial review procedure mean the Government attempted to immunise itself from challenge and whether the Appellant’s conviction should be quashed because of alleged flaws in the prosecution.  This will be heard in Courtroom 3.

On Wednesday 16 May, the Supreme Court will hand down the judgment in Rock Advertising Ltd v MWB Business Exchange Centres Ltd. The hand down panel will be Lord Kerr, Lord Sumption and Lord Carnwath. This appeal considered whether an agreement in writing which contains an anti-oral variation clause can be varied other than in accordance with the terms of that clause, and whether the Court of Appeal was wrong to follow a previous Court of Appeal decision in which a relevant contrary authority had not been cited, or a later Court of Appeal decision which considered both earlier decisions and rejected that contrary authority but did so obiter. The case also considered whether, on the findings of fact by the trial judge, there was a practical benefit which could amount to consideration at law, given the principle that a promise to pay an existing liability cannot amount to good consideration per Re Selectmove [1995] 1 WLR 474.

On Wednesday 16 May, the Supreme Court will hand down the judgment in R (Gallagher Group Ltd & Ors) v The CMA. The hand down panel will be Lord Kerr, Lord Sumption and Lord Carnwath. This appeal considered whether the principle of fair and equal treatment can require a decision-maker to replicate the effect of assurances given to one party that were made based on a mistake of legal principle in favour of other parties in a comparable position.

On Thursday 17 May, the Supreme Court will hear the appeal of Owens v Owens. This appeal will consider the interpretation of the Matrimonial Causes Act 1973, s 1(2)(b). This will be heard in Courtroom 1.
