On Tuesday 14 April 2015 the Court will hear the appeal of Aspect Contracts (Asbestos) Ltd v Higgins Construction Plc concerning an implied term in the parties’ contract that could allow the respondents to recover the payment they made to the appellants as a result of an adjudicator ruling, if they were successful in seeking a final determination by litigation. This will be heard in Court 2 from 2pm and will continue on Wednesday from 10:30am.

On Thursday 16 April the Court will hear the appeal of R (ClientEarth) v Secretary of State for the Environment, Food and Rural Affairs regarding a judgment by the CJEU on a question from the Supreme Court about the interpretation of the Air Quality Directive 2008/50/EC. The Court must decide if the Air Quality Directive requires the respondent to have prepared an air quality plan which demonstrates compliance by 1 January 2015 and what remedies it should provide where the respondent has not prepared a plan. It will be heard in Court 1 from 10.30am.

On Tuesday 14 April 2015 the Privy Council will hear the appeal of Leymunlall Nandrame & Ors v Lomass Ramsaran concerning whether a litigant may be entitled to a new trial of a civil claim in circumstances where he has a cause of action for negligence against his legal representatives for withdrawing his claim at trial after a settlement to which the litigant has not consented. This will be heard in Court 3 from 2pm. On Wednesday it will hear the appeal of Saverettiar v Saverettiar (Mauritius) regarding whether the judgment in favour of the respondent ought to be set aside as the court hearing took place in the appellant’s absence. This will be heard in Court 3 at 10.30am.
