On Monday 11 and Tuesday 12 May 2020, the Supreme Court will hear the appeal of Ecila Henderson (A Protected Party, by her litigation friend, The Official Solicitor) v Dorset Healthcare Trust. This appeal considers whether a claimant, during a serious psychotic episode, committed a criminal offence, which she would not have committed but for the defendant’s negligence, can recover damages for the consequences of having committed the offence, including her subsequent loss of liberty.

On Wednesday 13 May 2020, the Supreme Court will hand down judgment in R v Adams (Northern Ireland). This appeal will consider whether a decision to make an interim custody order under art.4 (1) Detention of Terrorists (Northern Ireland) Order 1972 was rendered invalid by the fact that it was made by the Minister of State and had not been considered personally by the Secretary of State.

On Wednesday 13 and Thursday 14 May 2020, the Supreme Court will hear the appeal of Mastercard Incorporated & Ors v Walter Hugh Merricks CBE. This appeal will consider the correct legal test for certification of claims as eligible for inclusion in collective proceedings as well as the correct approach to questions regarding the distribution of an aggregate award at the stage at which a party is applying for a Collective Proceedings Order.
