On Monday 11 April 2016 the Supreme Court will hear the appeal of Campbell v Gordon (Scotland) regarding whether, on the liquidation of a company, a director who has failed to obtain and maintain insurance on behalf of the company as required by statute, incurs personal liability to an injured party for loss arising from that failure. This will be heard in Court 1 from 11am.

On Wednesday 13 April it will hand down judgment in the cases of Lynn Shellfish Ltd & Ors v Loose & Anor concerning whether the appellants are entitled to take shellfish from certain sandbanks on the Eastern Wash in Norfolk or whether they are in fact trespassing on the respondents’ land; and In the matter of N (Children) (Adoption: Jurisdiction) concerning the applicability of Council Regulation (EC) No 2201/2003, art 15, to applications for care orders and the proper approach to the assessment of the children’s best interests on applications for transfer of care proceedings, in the present case from England to Hungary. These will be handed down in Court 1 from 9.45am.

On Wednesday it will also hear the appeal of Eclipse Film Partners No 35 LLP v Commissioners for Her Majesty’s Revenue and Customs and another case concerning the acquisition and disposal of licences for specified rights to distribute and/or exploit two films produced by Disney. This will be heard in Court 1 following the judgment hand downs and will continue on Thursday at 10.30am.

On Wednesday 13 April 2016 the Privy Council will hear the appeals of Grewals (Mauritius) Ltd v Koo See Lin (Mauritius); Koo Seen Lin v Grewals (Mauritius) Ltd (Mauritius) concerning whether the Supreme Court of Mauritius was right to find that KSL had been constructively dismissed by Grewals by 31 March 2002 and since Grewals had grounds to dismiss KSL for gross misconduct, severance allowance was payable only at the normal rate, rather than the punitive rate. This will be heard in Court 3 from 10.30am and will continue on Thursday.
