On Wednesday 3 until Thursday 4 October, the Supreme Court will hear the appeal of Volcafe Ltd & Ors v Compania Sud Americana De Vapores SSA (CSA). This appeal will consider where the burden of proof in relation to negligence lies in respect of alleged breaches of the Hague Rules, art III Rule 2 and the defence of inherent vice under art IV Rule 2(m). This will be heard in Courtroom 1.

On Wednesday 3 until Thursday 4 October, the Supreme Court will hear the appeal of In the matter of D (A Child). This appeal will consider whether the confinement of D, a young person aged 16, who lacked capacity or competence to make decisions about his residence and care, amounted to a deprivation of his liberty for the purposes of the ECHR, art 5, in circumstances where his parents were consenting to the confinement. This will be heard in Courtroom 2.
