On Monday 19 May and Tuesday 20 May is the appeal of R (Robinson) v The Governor of HMP Whatton & Anor and three other joined cases. In Court 2 from 11 am on Monday and 10.30 am on Tuesday.

 

The first two appeals, R (Robinson) v Governor of HMP Whatton & Anor and R (Massey) v The Secretary of State for Justice will decide whether the appellants were arbitrarily detained in breach of ECHR, art 5 for failing to provide coursework needed to demonstrate that a prisoner service a sentence of imprisonment for public protection could safely be released.

 

The second two appeals, R (Haney) v The Secretary of State for Justice and R (Kaiyam) v The Secretary of State for Justice will decide whether a delay in transferring the appellants to open prisons violated their rights under ECHR, arts 5 and 14 and whether the Court should depart from the precedent in R (James & Ors) v Secretary of State for Justice [2009] UKHL 22 and R (Clift & Ors) v Secretary of State for the Home Department [2006] UKHL 54.

 

On Wednesday 21 May the Court will hand down judgment in the following cases: Secretary of State for the Home Department v MN & KY, R (Barkas) v North Yorkshire County Council and Clyde & Co LLP & Anor v Winkelhof.
